Kogan Creek enterprise bargaining update

16 Oct 2026

Following the expiry of the Kogan Creek Energy Facility Enterprise Agreement 2023 earlier this year, CS Energy has been actively engaged in negotiations with employee bargaining representatives for a new enterprise agreement covering Kogan Creek Power Station employees.

On 8 October 2026, the Mining and Energy Union and Electrical Trades Union each lodged protected action ballot order applications with the Fair Work Commission to be able to undertake a vote of their members who are eligible employees to approve the taking of protected industrial action.

As a part of the orders made by the Fair Work Commission to undertake the vote(s), there are a range of potential actions to be voted on. These include a broad range of specified actions, from administrative restrictions to work stoppages.

The Fair Work Commission is scheduled to hear the application on 22 October 2026.

This process is one step in the legislative process as per the Fair Work Act 2009 (Cth), which must be completed before protected industrial action can occur, and no notice of protected industrial action has been received by CS Energy at this stage.

CS Energy has contingency arrangements to manage potential industrial action and ensure the continued safe operation of Kogan Creek Power Station. Depending on the nature of any action, these arrangements may include a safe and staged shutdown of the generating unit.

CS Energy remains committed to reaching an agreement through the bargaining process.
